1. The law firm of Sutts, Strosberg LLP was co-lead counsel in a securities class action commenced against Atlas Cold Storage Holdings Inc. and others.
2. On July 9, 2008, Justice Lax certified this action as a class proceeding and approved a settlement in the amount of $40 million.
3. Justice Lax signed an order permitting the Administrator to distribute the settlement proceeds to eligible class members. The Administrator has placed all cheques in the mail.
